Extension of temporary rental contacts during the corona crisis!

During the corona crisis, temporary lease contracts can be extended for a temporary period. This concerns contracts with a maximum term of 2 years.

The urgent bill Temporary Act Extending Temporary Leases was adopted by the Upper House on April 21, 2020. This offers a solution for landlords and tenants with a temporary lease that expires during the corona crisis.

Extension for a short period to a maximum of 1 September 2020!

The emergency law was passed for a short period and an extension was only possible for rental contracts ending between April 1 and June 30, 2020 for a period of 3 months, but up to September 1, 2020. Tenants had the option, after the landlord gave a notice in time about the expiration of the lease, to ask the landlord for an extension. To landlords the request to deal with this leniently and to grant the extension unless they already had agreements before 1 April 2020, for example to sell, demolish or renovate the house, if the landlord wants to live in the house himself, or if the tenant does not behave like a good tenant. Another reason could be that the landlord has already entered into a new lease with a new tenant.

Extension of the extension of the adaptation of the rules for temporary lease agreements up to 1 November 2020!

During the corona crisis, temporary lease agreements can now be extended until November 1, 2020. To give tenants more space and to prevent tenants from getting onto the street, the temporary law ‘extension of temporary lease contracts’ is extended by 2 months.

Leases that expire on August 31, 2020, can now be extended until November 1, 2020. This offers the tenant more space to search for a new home at a time when there are still limited measures. Leases that were previously extended under the temporary law until September 1, can now be extended again until September 1, 2020.

Send notice end of lease!

As a landlord, you are obliged to send a tenant notice of the expiration of the temporary lease. This must be sent in writing to the tenant a maximum of 3 months before and at least 1 month before the end date. During this corona crisis, you must therefore inform the tenant that he has the right to request an extension of the lease. If that has been agreed in writing and you have set a new end date, you must now also send the tenant a notice about the expiry of the lease. This must be sent in writing to the tenant a maximum of 3 months before and at least 1 month before the end date. Again, you must again inform the tenant that he has the right to request an extension of the lease. As long as the corona crisis continues and the restrictive measures continue to apply, there is a good chance that the temporary law ‘extension of temporary leases’ will be extended every time.
